TASSIE BOUND ADVENTURE TOURS TERMS AND CONDITIONS OF TRAVEL

PAYMENT AND CANCELLATION CONDITIONS
Full payment of the tour fee is required upon booking to confirm participation. Cancellations made less than 30 days from departure will incur 100% forfeit of fee. Payment confirms customer agreement to be bound by the business terms and conditions stated herein.

ITINERARY CHANGES
Tours are only cancelled if conditions are unsafe or by mutual consent of both Tassie Bound Adventure Tours and the customer. Tours are not cancelled due to hot weather, light rain, cloudy conditions or light winds. Tassie Bound Adventure Tours reserves the right to cancel a tour due to cold temperatures, rain in catchment areas, rain, poor visibility or strong winds. Cancellations made by Tassie Bound Adventures Tours will only be on the occasion where weather conditions make the tour unsafe to operate and a full refund will be provided. If the weather is unsuitable in the tour location, we will relocate the tour to an alternative location whenever possible and expect clients to honour their bookings. If the Gordon River Road is closed to 4WD only tours will still run and will collect you from Westerway, National Park or Maydena and provide 4WD transfers free of charge.

If your trip is cancelled due to bad weather or you cannot transfer to an alternative tour, we will refund any tour payments made.

Once a trip has started the financial risk of weather disruption transfers to the client. No refunds will be given if a client decides to leave a tour early. It’s the client’s responsibility to arrive to the pre-arranged pick up on time and we will not wait longer than 10 minutes for late guests. If guests are late and miss tour departure no refunds are provided.

Tassie Bound Adventure Tours reserves there right to refuse a participant to continue on the tour and arrange safe pick up and drop off, if participants are showing signs of being unconfident in the water or lack the necessary skills to complete the more difficult sections of the tour. No refund will be given if this scenario takes place.

SAFETY
Every aspect of our operation is designed to put safety first. As these tours are adventure activities, all risks cannot be eliminated. Our aim is to manage the risks to acceptable levels.
On guided tours the guide has responsibility for all safety decisions. The guide, or the company, may change trip plans or arrange support services to ensure client safety.
Your safety and enjoyment is our number one priority.

REBOOKING
Please call us on our mobile 0417 008 422 . There are no fees payable for rescheduling your tour seven days prior to tour departure. We are unable to reschedule your tour within seven days of tour departure time. However, if the rescheduling is due to unsafe weather conditions no fee is payable.

ASSUMPTION OF RISK AND RELEASE OF LIABILITY
In consideration of being permitted to participate in any way in Tassie Bound Adventure Tours’ kayaking programs, activities, events and trips I know, understand, agree and accept that:

  1. “KAYAKING” is a hazardous activity and that there is an inherent and significant real risk of injury , illness, death and / or permanent disability associated with any water activity even though particular rules, equipment and personal disciplines may reduce this risks; and,
  2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF TASSIE BOUND ADVENTURE TOURS, or others and assume all responsibility for my participation; and,
  3. I understand and acknowledge the dangers associated with THE CONSUMPTION OF ALCOHOL OR ANY MIND ALTERING DRUGS BEFORE AND DURING the activity and I take full responsibility for any injury , loss or damage associated with their consumption; and,
  4. I also agree to abide by and comply with any rules, instructions or directions properly given to me by any staff member, instructor or his / her delegate and understand that SUCH NON COMPLIANCE MAY RESULT IN INJURY, DEATH AND /OR PERMANENT DISABILITY OR REMOVAL FROM THE ACTIVITY at my own expense and that I agree to indemnify Tassie Bound Adventure Tours against all claims made by any person as a result of my failure to comply; and,
  5. I am mentally, physically and in all other respects fit and fully able to participate in kayaking tour and have no special medical requirements or conditions accept as described in the “Medical Questionnaire” to participate in this tour. The release shall serve as a release and assumption of risk for myself and for myself and for my heirs, administrators, executors and for all members of my family, including any minor accompanying me.
  6. I also agree that in the event of injury or illness, Tassie Bound Adventure Tours may provide evacuation, first aid and medical treatment at my expense and as such that I consent to such evacuation, first aid or medical treatment; and,
  7. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Tassie Bound Adventure Tours, their officers, officials, volunteers, agents and / or employees, other participants, sponsoring agencies, sponsors and if applicable, owners and lessors of premises used to conduct the activity (all of whom are referred to as “Releasees”) WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property , WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

‘Tassie Bound Adventure Tours’ accept that a duty of care and responsibility is owed to each client / participant under their direction and undertakes to take all reasonable steps to safeguard the welfare of the participant during the course of the activity undertaken.
